The Cost of the Lawsuit

The Association Attorney, David King, answered the question about the cost of the Lawsuit at the January 7, 2016 Board Meeting. However, there continues to be contradictions and questions about the cost of the Lawsuit. Hopefully this can answer it.

  1. The Lawsuit, against the Association, was filed by Barry O’Connell, Pat Long, Joseph Petraus, and Neighbors for a Better Roaming Shores Inc. on March 20, 2014.
  1. The Association’s out-of-pocket legal costs, as of the January 7, 2016 Board of Directors Meeting, for the Association to defend this Lawsuit, was about $39,000. These costs are from about March 20, 2014 until now. This defense money comes from Member dues and assessments.
  1. The Association/Board did not file the Lawsuit; the Board defended the Association against the Lawsuit. Even though the case is considered Closed, legal costs continue to accumulate. These continued legal costs are to execute the Settlement Agreement.
